Keeping track of Time off in lieu (TOIL)

Time Off In Lieu (TOIL) is time off that staff maybe allowed to take for hours worked beyond the normal working day. This can include working late, at weekends or travel/overnight stays for work related trips.

Whilst Companies are not legal obliged to pay employees for extra hours worked, TOIL is part of the EU Working Time Directive, a part of which is that no employee can be made to work more than 48 hours a week without prior written agreement (more information about working hours can be found on the ACAS website)

TOIL can be a very useful tool to manage temporary resourcing issues and to provide a level of flexible working for employees but it can also be difficult to monitor and can quickly get out of control.

There are a number of key factors to help HR with the successful management of TOIL:

  1. Make sure this is clearly defined in your contracts of employment
  2. Have a process in place to manage TOIL requests
  3. Keep staff informed of their TOIL balance
  4. Implement a suitable system to record and calculate TOIL

Managing TOIL doesn’t have to be complicated or time consuming. With People Inc. HR there are a number of ways to record and manage TOIL. One way is to simply add TOIL as ‘Additional Leave’

 

 

This is then added to the employees existing holiday entitlement.
